In this paper I analyse the problem of legal disagreements, initially raised by Ronald Dworkin against Hartian positivism. According to Dworkin, disagreements are pervasive, since law is an argumentative practice in which participants invoke normative arguments. Positivists, who claim that law depends upon agreement among officials, have difficulties to make sense of the fact that lawyers frequently disagree. I first present the main arguments in the debate. I then go on to distinguish different levels at which lawyers disagree. Taking these (...) levels into consideration, I articulate a pluralist reply that shows that the fundamental positivist tenets remain untouched by Dworkin’s challenge. (shrink)

El problema de los desacuerdos jurídicos puede ser planteado de diferentes modos. En una de sus versiones, el problema viene dado porque el positivismo asume que los conceptos jurídicos son criteriológicos, por lo que el desacuerdo entre juristas carece de sentido al ser una disputa meramente verbal. Plunkett y Sundell han ofrecido una respuesta novedosa a esta crítica que sostiene que no hace falta compartir un concepto para discrepar con sentido. Objetivo: El siguiente artículo tiene como propósito la revisión de la literatura existente cuyo enfoque sea las herramientas tecnológicas utilizadas para el abordaje del paciente con síntomas de salud mental, de manera virtual, para describir las ventajas, la eficacia, la efectividad y los beneficios de estas herramientas, a partir de la literatura encontrada. Métodos: se realizó una búsqueda en las bases de datos Pubmed, Elsevier, UpToDate, Journal of Medical Internet Research y Google Académico. Se identificó un total de 58 artículos (...) que versan sobre la eficacia y efectividad de las diferentes modalidades digitales (tales como aplicaciones, cuestionarios en línea, mensajes de texto, etc.) que tratan la salud mental. Resultados: la búsqueda realizada arrojó un total de 58 artículos. Tras la eliminación de duplicados, el número fue de 50 artículos. Después de la caracterización de la información basada en la revisión de la totalidad del contenido, fueron elegidos 30 artículos para que sirvieran como base para la construcción de la síntesis de datos. Conclusiones: las herramientas virtuales utilizadas en salud mental ofrecen un sin fin de beneficios para prestar un servicio con un acceso más sencillo a la población, de forma económica y efectiva, sin temor a que los pacientes sean estigmatizados al momento de buscar ayuda, como se pudo evidenciar en los artículos presentados. Además, las herramientas digitales utilizadas en psiquiatría han demostrado ser eficaces y seguras, sin embargo, son de reciente aparición y cuentan con una cantidad limitada de estudios que demuestren objetivamente su eficacia en esta área. This paper has two objectives: first, to rebut three misconceptions about the philosophy of Gilles Deleuze that deal with his position in ontology, aesthetics and science; and second, to probe deeper into two of these misunderstandings in order to discover their current scope. Both of these misunderstandings regard his views on ontology and on science. Here we will see how an ontology of difference and an intensive science arise. We explore two ways of distinguishing the semantic operation of kind terms. First, we focus on a distinction between terms with a flexible versus terms with an inflexible semantics. Flexibility depends on whether some changes in the domain of application are taken to be possible while being consistent with past usage and what is intuitively the same meaning. On the other hand we discuss terms whose mode of operation is tolerant, in that the cohabitation in the speakers’ community of more (...) than one use or practice of use of the term in question is accepted. Those terms contrast with terms that operate in a strict way restricting severely the legitimacy of different uses that cut the domain of application in different ways. Among the latter we include terms with an ethical component and terms whose correct application involves high stakes. These distinctions are not new, since the phenomena that we identify as flexibility and tolerance have been observed, although in our view they have not been properly systematized and assessed. We argue that the two distinctions throw light on the bases of some disputes and on some legal disagreements. (shrink)

In this work we examine critically how two competing approaches to meaning account for disagreements. We will argue that Hart's conventionalist stance does not commit him to descriptivism. That non-descriptivist theories of reference, properly understood, can account for a vast array of cases of interpretive disagreement and that and that an account of different kinds of disagreement can be provided from a conventionalist perspective within the framework of non-descriptivist theories of reference.

The concept of convention has been used in different fields and from different perspectives to account for important social phenomena, and the legal sphere is no exception. Rather, reflection on whether the legal phenomenon is based on a convention and, if so, what kind of convention is involved, has become a recurring issue in contemporary legal theory. In this book, some of the foremost specialists in the field make significant contributions to this debate. In the first part, the concept of (...) convention is analysed. The second part reflects on whether the rule of recognition postulated by Hart can be understood as a convention and discusses its potential and limitations in order to explain the institutional and normative character of law. Lastly, the third part critically examines the relations between conventionalism and legal interpretation. Given the content and quality of the contributions, the book is of interest to those wanting to understand the current state of the art in legal conventionalism as well as those wanting to deepen their knowledge about these questions. El artículo que se presenta tiene entre sus propósitos valorar las tendencias contemporáneas de la superación en liderazgo docente en Latinoamérica, así como de los principales (...) modelos y teorías donde se incluye además, una estimación de los diversos estilos de liderazgo y su importancia para el logro de un rol transformador en el docente de la educación superior. Quality higher education institutions have the characteristic to develop a pedagogy of change. Since 1999, the Education Regional Office for Latin America and the Caribbean established a program of the educative leadership net, in order to create a critical group of professionals of the educative system, pioneers in transformational leadership. One of the main purposes of the following article is to assess contemporary trends of the bettering processes in teaching leadership in Latin America, as well as, the main models and theories. Las naciones y pueblos indígenas presentan preocupantes índices respecto a la salud, así como otras carencias como la pérdida de sus tierras, la alimentación, la educación y, en general, el ejercicio de sus derechos, consagrados por organizaciones internacionales como la ONU y la OMS-OPS. En Ecuador, de acuerdo con el orden jurídico constitucional, se han instrumentado políticas de salud que incluyen el lineamiento general de un enfoque intercultural de la atenciónprimaria que incorpora los saberes y prácticas ancestrales. En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. The present paper deals with the ontological status of numbers and considers Frege ́s proposal in Grundlagen upon the background of the Post-Kantian semantic turn in analytical philosophy. Through a more systematic study of his philosophical premises, it comes to unearth a first level paradox that would unset earlier still than it was exposed by Russell. It then studies an alternative path, that departin1g from Frege’s initial premises, drives to a conception of numbers as synthetic a priori in a more (...) Kantian sense. On this basis, it tentatively explores a possible derivation of basic logical rules on their behalf, suggesting a more rudimentary basis to inferential thinking, which supports reconsidering the difference between logical thinking and AI. Bajo el manto liberal se engloban todas aquellas teorías políticas cuyo objetivo es buscar procedimientos, universalmente compartidos, de agregación de los intereses individuales. Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. En este artículo se busca comprender las epistemologías de la manigua, entendidas como, un complejo sistema de conocimientos y vida, en diálogo con el monte y el agua en el Departamento de Chocó, Colombia. Las categorías de ‘conocimiento ancestral’ y ‘tradicional’ le asignan un carácter involutivo al ribereño; lo anclan al pasado. Las epistemologías de la manigua como metodología implican un diálogo interepistémico entre el método genealógico y las mañas de Tío Conejo, Ananse, Miguel Caicedo, Jaime Arocha, Sergio Mosquera, Lydia (...) Cabrera, en especial, Rogerio Velásquez. La oralidad representa potentes guayacanes3. Los ribereños son portadores de conocimientos propios: espiritualidad, ombligamiento, partería, etc. Esta racionalidad se encuentra amenazada por el colonialismo. (shrink)

Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. However, through the playful footpaths of enchanted Galician Meigas, I rehabilitate some relevant discussion on the justification of belief formation and come to some poignant philosophical insights regarding the understanding of possibilities. Este artículo se propone mostrar que el significado de aisthesis para Protágoras responde al uso y significación de la filosofía jónica, esto es, aún significa indistintamente juicio, sensación, emoción, creencia, en fin, doxa. Esto tiene una consecuencia muy relevante para la comprensión del homo mensura y la tesis que afirma: aisthesis es episteme.

In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

Fazer a genealogia do poder nunca foi o propósito claro de Foucault. No entanto, a questão do poder foi tema recorrente em suas investigações a ponto de estudiosos do trabalho do filósofo sugerirem uma divisão e organização de seu trabalho a partir de três eixos teóricos. Dentro dessa perspectiva, a analítica do poder marcaria a trajetória filosófica de Foucault na década de 1970. De fato, até 1994, ano de publicação do conjunto de textos, entrevistas e conferências de Foucault no Dits (...) et écrits, a questão da analítica do poder era majoritariamente conhecida a partir de livros como Surveiller et punir e Histoire de la sexualité I: la volonté de savoir. Com o início da publicação dos cursos no Collège de France a partir de 1997 as interpretações a respeito da analítica do poder sofrem um alargamento. Mas é somente em 2015 que a totalidade dos cursos de Foucault no Collège de France foram publicados, abrindo um importante caminho para a investigação a respeito das primeiras reflexões a respeito do poder. No presente artigo procuramos mostrar como os primeiros passos da analítica do poder de Michel Foucault se dá a partir de um contexto gauchiste ainda configurado em termos de dinástica do saber. Nesse sentido, procuramos mostrar como o período da dinástica corresponde a um esboço teórico, tentativas primeiras de conceituação do poder, marcadamente desenvolvido em contraposição com o marxismo. Essa contraposição se dá sobretudo na recusa tanto do esquema marxista de infra-superestrutura, quanto do modelo contratualista de sociedade estatal. (shrink)

This paper explores the filmic trajectories experienced by the protagonists in two case studies: Lightning Over Water by Nicholas Ray and Wim Wenders, and Sick, The Life and Death of Bob Flanagan, Supermasochist by Kirby Dick. In both films, the limitexperience, caused by a disease, becomes an active device, one that produces knowledge for the protagonists. In this radical experience, what is revealed is the link between selfrepresentation and a will to self-destruction, and the normative margins of rationality are questioned. (...) Based on the studies of Jean-Luc Nancy, Jean Baudrillard and Clément Rosset, this essay examines an approach to terminal illness and self-representation both in the context of pain and the voyeuristic process of death as a spectacle. The question around foreigners and their obligation to respect and fulfil the national - or civil - norms of the territory where they are; has become due the migration and multicultural movements once again a key one. Addressed by a multitude of authors along the centuries, the question has been answered based on the different placements around juridical and political concepts like citizenship, sovereignty, authority or law. In this investigation, the doctrinal development carried out around the obligatory nature of the (...) civil norm for foreigners in Spanish scholasticism is going to be considered. Specifically, due to its thoroughness and depth, the doctrine done by Francisco Suarez is going to be critically analysed. Once the answer given in our author's doctrine to the question posed has been established, we will consider the possible influences in the Anglo-Saxon sphere. (shrink)

The figure of chiasmus, which plays a key role inside Merleau-Ponty’s thought, makes it possible to address the way Castoriadis defines the imaginary throughout his entire work from a new perspective, as well as to shed light on some complexities concerning the relation between instituted and instituting. Tthis article emphasizes the intertwining of three pair of concepts, each of which corresponds to a different but yet interrelated aspect of his philosophy: psyche-society, tradition-innovation, and autonomy-heteronomy.

We propose that marketing of unhealthy foods and beverages to Black and Latino consumers results from the intersection of a business model in which profits come primarily from marketing an unhealthy mix of products, standard targeted marketing strategies, and societal forces of structural racism, and contributes to health disparities.

En 1919, la même année où Jean Giraudoux fait son « Adieu à la guerre », il écrit « Les morts d’Elpénor ». En 1926, à côté de trois autres histoires, ce texte intégrera le corps d’Elpénor, déterminant l’ensemble, une collection de quatre textes écrits pendant dix-huit ans, le premier étant « Cyclope », écrit en 1908 ; le deuxième, « Sirènes », en 1912 ; le troisième en 1919 ; et le dernier en 1926, « Les nouvelles morts d’Elpénor (...) ». Quand « Cyclope » et « Sirènes » sortent respectivement chez Le Matin en 1908 et chez Paris-Journal en 1912 aucun d’entre eux ne mentionne Elpénor. Bref, c’est avec le développement des deux dernières histoires, que Elpénor, cette figure effacée chez Homère et absente dans les deux premiers textes de Giraudoux, vole la vedette. Cet article voudrait montrer comment la mise à jour du héros et de ses histoires est en dialogue avec la guerre vécue par l’auteur, pour proposer comment les vieilles histoires, lorsqu’elles sont renouvelées, participent à un processus qui leur permet d’élaborer les défis du présent, communiquant le présent, à travers un code déjà public, l’Odyssée. In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . The purpose of this essay is to look at whether Aquinas teaches in De veritate [DV], q. 1, a. 4, that truth is a form inherent in things. I take up this investigation because I am examining Lawrence Dewan's account of Aquinas's teaching on truth.1 On Dewan's account, a significant development occurs in Aquinas's teaching as regards truth as it is found in things. Before the Summa theologiae [ST], Aquinas thought that in addition to truth being in the intellect, it (...) was also in things. In ST, most explicitly in I, q. 16, a. 6, Aquinas no longer thinks that it is in things, but only in the mind. When Dewan says that before the ST truth is "in things" and in the ST it is not "in things," in both cases, by "in things," Dewan means "as a form inherent in things." What exactly this means for Dewan will be gradually brought out as I examine the text Dewan thinks most clearly teaches that truth is a form inherent in things: DV, q. 1, a. 4. (shrink)
